Data Rights and Election Register Review Procedure

This procedure explains how IQSK members and other authorised users may raise concerns about personal data processed through the IQSK Elections Portal, including concerns about inclusion in the election register.

Who may use this procedure

IQSK members whose personal data appears in the election register.

IQSK members who believe they have been wrongly excluded from the election register.

Candidates, proposers, seconders, and other authorised users whose personal data is processed through the Portal.

Types of requests

Access requests.

Correction requests.

Objection requests.

Restriction requests.

Erasure requests, where legally appropriate.

Election register review requests.

Important position on deletion from the election register

A member may request deletion or removal of personal data from the election register, but deletion is not automatic.

The Commission must consider whether the data is still necessary for voter eligibility, election administration, election integrity, audit trails, dispute resolution, legal compliance, or institutional accountability.

Where deletion is not appropriate, the Commission may instead consider correction, restriction of processing, suppression from non-essential publication, anonymisation, or other proportionate safeguards.

Grounds for review or deletion

Wrong inclusion in the register.

Wrong exclusion from the register.

Incorrect name, membership number, contact details, or eligibility status.

Outdated or excessive data.

Unlawful processing or over-retention.

Improper public or semi-public display of register information.

How to submit a request

Requests should be submitted in writing to the IQSK Independent Elections Commission.

Use a clear subject line such as `Election Register Correction Request`, `Election Register Erasure Request`, `Data Access Request`, or `Voter Eligibility Review Request`.

Include your full name, membership number where applicable, contact details, election year or election concerned, nature of the request, details of the data concerned, and any supporting documents.

Review process and timelines

The Commission should acknowledge receipt, verify identity, identify the data concerned, assess the request, consider election integrity impacts, and communicate a written decision.

As an internal guide, IQSK should aim for 7 days for access requests and 14 days for correction, objection, or erasure requests, subject to applicable law and verification needs.

Register review requests should be prioritised during election periods where approaching deadlines may affect a member’s voting rights.

Possible outcomes

Correction of the data or update of the election register.

Restriction of processing, suppression from non-essential display, or anonymisation.

Retention of data where necessary for election integrity, audit, dispute resolution, legal compliance, or accountability.

Deletion of personal data, where lawful and appropriate.

A written decision declining the request in whole or in part, with reasons.

Referral or escalation through IQSK review channels or the Office of the Data Protection Commissioner where appropriate.
